We want you to get the most out of your time at the gym. By purchasing a membership you are agreeing to the terms and conditions detailed below. Please take the time to read these. We advise you to sign on only if you understand and agree to these terms and conditions, so please contact us if you require any clarification prior to accepting them.
- nuckle, we, us, our means KOACH Pty Ltd trading as nuckle ABN 21 144 864 326.
- Gym, Studio, means the premises at 6 Byres Street Newstead, 4006.
- The Member/you means you the member of nuckle gym as per the details supplied in this membership application.
- DD means direct debit.
- Gym Rules means the rules regulating the operation of equipment, gym opening hours and Gym Protocols specified in these terms and conditions, in any signage at the gym and in any handouts or email notifications provided by nuckle.
- Membership Plan, Membership, or Plan mean this Membership agreement between nuckle and you.
- Minimum Term means the minimum commitment period of your membership. This is 52 weeks for 12 Month Memberships and 2 weeks for Flexible Memberships.
- Session, Class means a standard 45-60 minute nuckle class, comprised of a warm-up, training and a cool-down period.
NUCKLE TERMS AND CONDITIONS
Your nuckle Membership is valid for your Minimum Term. Memberships are assigned to each member and cannot be transferred to another person.
TERM AND RENEWAL
Flexible: Your membership is ongoing with a minimum term of two weeks, which automatically renews until cancelled.
Fixed Term: Your Membership is valid for your Minimum Term, and will automatically renew at the end of the term, unless cancelled. 2 weeks prior to the end of the Minimum Term, you will be sent an email to confirm the renewal or cancellation your Membership.
Special Offer: Your membership is valid only for the limited term specified in the special offer and will not automatically renew.
All members are required to keep an active credit/debit card on file to be used for membership payments, retail purchases or any other purchase within the gym.
Your entitlements and access are revoked if your nuckle account is in arrears.
START UP FEE
The Start Up fee contributes towards insurances, administration and the associated costs of setting up each individual member. It is due on the date of joining.
TRAINING FEES – DIRECT DEBIT
Training Fees will be debited from your nominated bank account or credit card for the Minimum Term in fortnightly or weekly instalments as nominated by you on sign-up. The start-up fee will be deducted with the first instalment.
TRAINING FEES – UPFRONT
Training Fees for Upfront Memberships are paid upfront in full at a discount. The specified amount includes the start-up fee.
LATE CANCELLATION FEE – CLASSES
A late cancellation fee of $15 may be charged, where a class booking is cancelled less than 8 hours before the scheduled class start time. It applies to both members and 10 pack holders.
WAITLIST – CLASSES
If a class session is full you can join a waitlist. Everyone on the waitlist is notified by email when a place in that session becomes available. You will need to book into the session to confirm your place.
10 class passes are valid for any standard nuckle class at the studio and have a 3 month validity from the date of purchase. Class packs are non-transferrable.
Most nuckle classes and training take place at the studio. From time to time we may take classes in other outdoor locations or other premises. These Terms and Conditions apply to all nuckle activity in any location.
As a member, you’re entitled to attend as many regular classes as you wish, subject to availability. Class numbers are capped and bookings are required via the nuckle glofox app. Classes become available to book 8 days in advance. nuckle may vary the class schedule and number of classes offered per week at any time.
We offer Personal Training and challenges. These services are not included in your Membership.
PERSONAL TRAINING (PT) SESSIONS
Single PT sessions are valid for one person and Pair PT sessions are valid for two people. It’s no problem to bring a guest to any of your PT sessions if discussed in advance with your trainer. An additional fee of $20 per additional person will apply, payable on the day.
A 24 hour cancellation policy applied to booked PT sessions. Cancellations made within 24hours prior to the PT session will forfeit the full rate of the session. PT 10 packs have a 3 month validity from the date of purchase. PT packs are non-transferrable.
nuckle reserves the right to allocate a suitable trainer if your nominated trainer is not available for any session.
SUSPENSION OF MEMBERSHIP
You’re entitled to suspend your membership for a minimum of two weeks at a time up to a maximum of 6 weeks in any 12month period. The suspension period must commence on a Monday. 7 days advance notice in writing is required (email to [email protected]). A fee of $5.00 per week applies to suspend your membership. Your Membership will be reactivated after the suspension fees have been paid.
Your level of membership provides you with access to all standard nuckle classes. The Gym and equipment is not available for use outside of classes.
HOURS OF OPERATION
nuckle’s operating hours are available on our website and glofox booking app. We reserve the right to change class times at our absolute discretion. nuckle will be closed from 22 – 26 December. No fee reductions are applicable for this closure.
nuckle is generally closed for group classes on public holidays. At our discretion, we may choose to run classes or PT’s on public holidays. However, there shall be no fee reduction if we choose to remain closed on public holidays.

Fixed Term: If you choose to cancel your membership before the Minimum Term expires, a cancellation fee is applicable calculated at $20.00 per week from the cancellation date through to the end of your Minimum Term with a minimum fee of $200 applicable.
Flexible: You may cancel your membership at anytime with a minimum of 2 weeks written notice. Your 2 week notice period will commence on the date of your next scheduled Direct Debit payment, provided we receive your written notice at least 72 hours prior.
Foundation: These memberships offer services at a significant discount to reward our most committed members. Refunds under general circumstances are not permitted, however, will be considered for compassionate or extenuating circumstances in agreement with the company directors.
nuckle reserves the right to Terminate this Membership if the member fails to abide by any of these Terms and Conditions or any of the Gym Rules and/or engages in criminal or unlawful action
The Member acknowledges that our Direct Debit Providers have been engaged by nuckle to collect the fees due under this Membership (if paying by DD) and also acknowledges that all rights of the gym regarding payments under this Membership are able to be enforced by our payment providers as if it were the gym without any involvement on the part of the gym or the consent of the Member.
DEFAULT DD PAYMENTS
If your scheduled direct debit payment fails, our payment providers may charge you a fee for each failed transaction. Unfortunately, this is not something we can control. We encourage you to ensure sufficient funds are available in your nominated account to cover fees and advise us in advance if your bank account or credit card account has closed or changes.
We strongly advise you take the advice of a medical practitioner or appropriate specialist prior to commencing any new exercise program, particularly if you’re in any doubt about your ability to engage in physical exercise.
It’s your responsibility to inform us in advance of any injury, illness or other reasons that may pose a risk to your health prior to commencing physical activity, and again at commencement of each class or PT session.
By accepting the membership you acknowledge yourself as being in reasonable physical condition and that you know of no medical or other reason why you’re not capable of engaging in physical exercise and that such exercise would not be detrimental to your health, safety, comfort or physical condition.
nuckle staff and its contractors are not medically trained and are therefore not qualified to assess whether you’re in good physical condition and/or that you can engage in physical exercise without detriment to your or their health, safety, comfort or physical condition.
OPERATION OF FACILITIES AND EQUIPMENT
It is your responsibility to ensure that you understand the operation of equipment provided by nuckle prior to their use and that they are operated correctly. Should you have no prior experience with a piece of equipment, or any doubt about correct usage or technique then a staff member should be consulted before use. Any damage to facilities or equipment caused by the negligence or wilful act of yourself shall be your responsibility.
Membership Terms and Conditions, nuckle services and facilities, Gym Rules, Membership Fees, Training Fees, other charges and any discounts may change from time to time. We will endeavour to give at least 14 days advance notice of proposed changes via email and posted on our website www.nuckle.com.au. Such changes shall be automatically applied after this notified period.
